These Terms of Service ("Terms") govern your access to and use of the websites, quote tools, and the "RCG Cost Segregation Advisor" application for ChatGPT (collectively, the "Services") provided by RCG Valuation & Monetization[, LLC] ("RCG Valuation," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. What the Services Do

The Services provide preliminary, educational cost segregation study pricing and depreciation estimates and let you request a follow‑up consultation with an RCG Valuation professional. The Services help you understand potential cost segregation benefits and connect with us; they do not perform a cost segregation study.

2. Educational and Pre‑Qualification Only — No Professional Advice

All information, quotes, and estimates provided through the Services are for general educational and pre‑qualification purposes only. They are not tax, legal, accounting, engineering, or investment advice, and no professional‑client relationship is created by your use of the Services. You should not act on any output without consulting a qualified professional. A reliable cost segregation result requires a professional engineering‑based study and review by your own tax advisor.

3. Estimates Are Not Guarantees

Quotes, fees, depreciation figures, Section 481(a) amounts, and any other numbers produced by the Services are preliminary estimates based on the information you provide and generalized assumptions. Actual study pricing and tax outcomes may differ materially. We do not guarantee any particular fee, deduction, tax saving, or result, and nothing in the Services should be relied upon to prepare a tax return.

4. Information You Provide

You agree that information you submit (such as purchase price, location, and property details) is accurate to the best of your knowledge. Estimates depend on this information; inaccurate inputs produce inaccurate estimates. Any property‑record data displayed is third‑party reference information that may be incomplete or out of date and does not affect our pricing.

5. Consultation Requests and Communications

If you request a callback or consultation, you consent to RCG Valuation contacting you using the contact details you provide (by phone, text, or email) about our services. You may opt out at any time by contacting us. Message and data rates may apply.

6. No Purchases Through the App

The Services do not sell any product or process any payment within ChatGPT or the quote tools. Cost segregation studies and related professional services are engaged separately under a distinct agreement between you and RCG Valuation, with their own terms and fees.

7. Third‑Party Platforms and Data

The Services operate on and alongside third‑party platforms (including OpenAI's ChatGPT) and use third‑party property‑data providers. Your use of those platforms is subject to their own terms and privacy policies. We are not responsible for third‑party services, and their availability is outside our control.

8. Acceptable Use

You agree not to misuse the Services, including by attempting to disrupt or reverse‑engineer them, using them unlawfully, submitting false information, or infringing others' rights.

9. Intellectual Property

The Services, including their content, software, and branding, are owned by RCG Valuation or its licensors and are protected by applicable laws. We grant you a limited, revocable, non‑exclusive license to use the Services for their intended purpose. All rights not expressly granted are reserved.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON‑INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error‑free, or that any estimate is accurate or complete.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RCG VALUATION AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR TAX BENEFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

12. Indemnification

You agree to indemnify and hold harmless RCG Valuation from any claims, losses, or expenses arising out of your misuse of the Services or violation of these Terms.

13. Privacy

Your use of the Services is also governed by our Privacy Disclaimer, which explains how we handle the information you provide.

14. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted, and your continued use of the Services constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict‑of‑laws rules. Any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona.
